This page states the “Terms and Conditions” under
which you (the User) may use nannyjob.co.uk. Please read this page
carefully. If you do not accept the Terms and Conditions stated
here, do not use this web site. By using the nannyjob web site,
you are indicating your acceptance to be bound by the terms and
conditions. Jobs on the Net Ltd (the Company) may revise these terms
and conditions at any time by updating this posting.
Description of the Service
nannyjob.co.uk is an online service publishing information for
individuals and organizations relating to work as a nanny or child
carer. The site also hosts a fully automated job board that enables
Users to either advertise vacancies or search for jobs within the
childcare sector. nannyjob.co.uk also gives users the opportunity
to submit and view CVs. The site is not a Recruitment Agency as
defined by the Employment Agencies Act 1973 and therefore not covered
by the Conduct of Employment Agencies and Employment Businesses
Regulation of 2003
The Provision of the Service
nannyjob.co.uk allows each User to submit job vacancies, search
for jobs, submit and view CVs. We also offer banner and logo advertising
opportunities
It is the User's responsibility to protect their computers against
any viruses.
Each User grants Jobs on the Net Ltd the right to disclose to third
parties certain aggregate information provided by the user. The
Company will not disclose to any third party your e-mail address.
The Company reserves the right to contact Users with information
and publicity material.
Jobs on the Net Ltd does not vet, interview or carry out any background
checks of any kind on any of the Users who post vacancies or CVs
on nannyjob and for the avoidance of doubt we do not make any representation
or give any warranty for the accuracy or fitness for purpose of
any information on nannyjob and the use made of any information
provided by you passed to by a User and we accept no liability whatsoever,
in respect of any employment or actions resulting from the use of
this site.
Use of the Service
Each User’s right to use the service is personal to that
User and no User may resell or make any commercial or business use
of the service.
By submitting a vacancy or CV, the User is authorising Jobs on the
Net Ltd to display the vacancy or CV on the “nannyjob”
web site.
The User is responsible for the content of the vacancy or CV and
will indemnify Jobs on the Net Ltd against any claim, loss, liability,
expense and/or damage ("Losses") in connection therewith.
Jobs on the Net Ltd does not guarantee that the User will receive
any responses to its displayed job vacancies or CV.
Applicants' responses will be automatically forwarded by Jobs on
the Net Ltd to the user. The User is responsible for verifying the
information contained in applicants' responses and Jobs on the Net
Ltd accepts no responsibility for the content of any such application.
In particular, but without limitation, for vacancies the User is
responsible for verifying the Applicant's identity, eligibility
to work, experience, training, qualifications and authorisations
required by the User, by law or by any relevant professional body
for the vacancy.
For vacancies posted, the User shall provide sufficient details
about itself and the vacancy to Applicants including without limitation
the User's identity, the nature of its business, the nature of the
role, the type of work to be performed, the commencement date, the
likely duration, the hours of work, the location, the remuneration,
the intervals of payment and benefits, and the notice periods required
to be given and received.
All and any subsequent dealings between the User and any Applicant
and in connection with the Applicant's response to the vacancy or
CV are the responsibility of the User and Jobs on the Net Ltd accepts
no liability whatsoever therewith. The User will indemnify Jobs
on the Net Ltd against any Losses in connection therewith.
The User will comply with the provisions of the Data Protection
Act 1998 in relation to all Applicants' details and indemnify Jobs
on the Net Ltd against any Losses in connection therewith.
The User will comply with all anti-discrimination legislation including
but not limited to the Sex Discrimination Act 1975, the Race Relations
Act 1976, the Disability Discrimination Act 1995 and the Employment
Equality (Age) Regulations 2006. The User will indemnify Jobs on
the Net Ltd against any Losses in connection therewith.
The User shall not post any vacancy or CV that directly or indirectly
promotes age, sex, race or disability discrimination. The User will
indemnify Jobs on the Net Ltd against any Losses in connection therewith.
The User, if an employment agency or an employment business as defined
in the Conduct of Employment Agencies and Businesses Regulations
2003 ("the Regulations"), will comply with the provisions
of the Regulations and the Employment Agencies Act 1973 in relation
to all vacancies posted on Jobs on the Net Ltd's site, communications
with Applicants and management of Applicants' details and indemnify
Jobs on the Net Ltd against any Losses in connection therewith.
Jobs on the Net Ltd monitors the quality of vacancies and CVs from
time to time in order to provide a better service to candidates.
The User must satisfy itself of the qualifications and/or authorisations
required by law or by any relevant professional body in respect
of a vacancy.
For a vacancy, the User shall not post any vacancy where there
is a risk to the health and safety of any Applicant at the location
where the work is to be performed.
For a vacancy, the User accepts responsibility for any detriment
which it may suffer or incur in respect of the engagement of an
Applicant and shall hold Jobs on the Net Ltd harmless against any
Losses in connection therewith. The User shall use all reasonable
endeavours to ascertain that it will not be detrimental to the interests
of the Applicant it intends to engage (if any) to work for the User
in the vacancy posted.
For a vacancy, the User shall include in the job description any
qualifications and/or authorisations required by law or any or by
any relevant professional body. If the rate of pay is included,
the job description must also include the nature of the work, the
location, minimum experience, training and/or qualifications required
in order for an Applicant to receive such rate of pay; and/or where
the User is employment agency or employment business, it must state
in which capacity it is acting in relation to the vacancy.
Jobs on the Net Ltd reserves the right in its sole and absolute
discretion to remove any vacancy or CV or suspend a vacancy account
at any time without reason. Examples of vacancies that may be removed
and that can and can result in account suspension include, but are
not limited to those that:
• Jobs on the Net Ltd considers illegal, inappropriate or
fraudulent
• directly or indirectly require or ask for application or
registration fees
• advertise franchise, pyramid, network marketing or get-rich-quick
schemes
• have been indiscriminately posted or duplicated across multiple
sectors
• advertise websites, services, businesses, business opportunities
and/or contact details
• vacancies that do not actually exist or have already been
filled
• multiple postings of the same vacancy (a single vacancy can be posted
once and renewed a maximum of two further times)
• multiple versions of the same vacancy
Jobs on the Net Ltd reserves the right in its sole and absolute
discretion to close any account at any time without reason. Examples
of accounts that may be closed include, but are not limited to those
that:
• have not provided full or accurate contact or company information
• Jobs on the Net Ltd considers to be acting inappropriately
or illegally
• use nannyjob.co.uk to advertise websites, services, businesses
and/or business opportunities in any part of the job vacancy or
on any part of the site.
By accessing or using any part, service or feature of this site,
the User agrees to use it in 'good faith' i.e. to post authentic,
impartial and unique jobs of reasonable quality, which provide both
adequate and accurate job details. The User also agrees that any
abuse of the service, website or these terms and conditions can
result in the User's access to this service being removed, and accounts
terminated.
The definition of what constitutes abuse is at the sole discretion
of Jobs on the Net Ltd.
Company’s Liability
nannyjob.co.uk is only a recruitment resource. The Company allows
individuals and organisations to post job opportunities and candidates
to post CVs. It does not screen or censor the listings offered,
has no independent means of verifying the accuracy of any information
and is not involved in the transaction between candidates and employers.
As a result, nannyjob has no control over the safety, security,
accuracy or legality of the vacancies or CVs advertised and information
provided. Jobs on the Net Ltd therefore cannot be held liable for
any resulting loss.
Disclaimer of Warranties
Jobs on the Net Ltd does not warrant that the service will meet
any particular requirements of the User or that the service will
be uninterrupted or error free.
Jobs on the Net Ltd does not give any warranty in respect of goods
or services purchased or obtained through the service or any transactions
entered into through the service.
Payment for services
For some services a payment is required. The payment is either
in advance via the automated paypal service, or on receipt of invoice
from Jobs on the Net Ltd. All invoices, statements of account, receipts
and paypal confirmations of payment will be sents by e-mail in electronic
format. We reserve the right to suspend any nannyjob account for
non payment of invoices.
Limitation of Liability
Each user agrees that he or she uses the service at their own
risk. Jobs on the Net Ltd cannot accept any liability either in
contract, tort or otherwise for any direct, indirect or consequential
loss resulting from the use or the inability to use the service.
General
From time to time Jobs on the Net Ltd will contact Users in order
to evaluate the service they receive and also to promote Jobs on
the Net Ltd's nannyjobpayroll services and products.
Jobs on the Net Ltd reserves the right to charge for the services
as it sees fit and in its sole and absolute discretion, provided
that such charge (if any) shall not be retrospective.
Jobs on the Net Ltd reserves the right to change any aspect of
the nannyjob service and/or these terms and conditions, at any time
without notice.
Jobs on the Net Ltd cannot guarantee that the site will operate
continuously without interruptions or be error free and can accept
no liability for its unavailability. We do not accept any liability
for loss of data or interruption to the service caused by the breakdown,
error, loss of power or otherwise caused by or to your computer
system
nannyjob.co.uk reserves the right to use, decline, reject or revise
anything that is sent to us via the site, via e-mail or in writing
via the post.
We reserve the right to bar any person or organisation from using
nannyjob.co.uk if it is found that they have been using the site
improperly. If any person discovers offensive or improper information
displayed on the site, nannyjob.co.uk should be contacted immediately
at info@nannyjob.co.uk.
These terms and conditions do not confer any rights on any third
party pursuant to and in accordance with the Contract (Rights of
Third Parties) Act 1999.
Linked web sites
Jobs on the Net Ltd makes no representations in relation to any
other web sites which you may access through nannyjob. We have no
control over the content or availability of any linked web site.
In addition, a link to any other web site does not mean that we
endorse or accept any responsibility for the content, or for the
use of, such a web site and we shall not be liable for any loss
or damage caused or alleged to be caused by or in connection with
use of or reliance on any content, goods or services available on
or through any other web or resource.
Jurisdiction
The agreement and the use of nannyjob is governed by and construed
in accordance with the laws of England.
